Warwick District Council has agreed to a Tree Preservation Order (TPO) preserving all the trees on the green space in front of buildings in Smalley Place and along the side by Barrow-field Lane.

Liberal Democrat councillor Pat Ryan (Abbey ward), who first put the TPO proposal to the town council last year, said:
"I put this proposal forward the on the first occasion that the new proposals for the town centre were put before the Town Council, since I believed that the trees there, especially the magnificent cedar in front of the Police Station, make a huge contribution to the townscape at that point. I also believed that it would have the effect of preserving the green spaces at Smalley Place, whatever the future would bring.
Now, looking at the map attached to the TPO, it seems quite clear that the green spaces have to be kept to avoid damage to the root systems of the trees concerned."

Local campaigner John Whitehouse (Abbey ward team) said:
"In the public debate about the future of Smalley Place, Kenilworth Liberal Democrats have argued consistently that it was the trees and green open space that must be retained, not necessarily the existing buildings behind them. Now that these have been secured, perhaps we can have a more rational public debate about the future use of the site?"
